Widget Placement: The Hard Rules

Article 50(5) sets two absolute requirements:

1. Timing: Disclosure must be provided at the latest at the time of the first interaction. Not after the user has typed their first message. Not after they've already consumed AI content. Before or at the moment of exposure.

2. Accessibility: Disclosure must conform to applicable accessibility requirements. This means:

- Screen-reader accessible (use aria-labels on badge elements)

- Sufficient color contrast (WCAG AA minimum)

- Not hidden by animations or overlays

Can I Just Put It in My Privacy Policy?

No. Article 50 requires disclosure at the point of interaction — not in a separate document. A privacy policy link does not satisfy Article 50. The disclosure must be part of the user experience, not a legal footnote.

Three Mistakes to Avoid

1. Hidden disclosure. "Powered by AI" in 8px font at the bottom of a 10,000-word page. Not compliant.

2. Delayed disclosure. Telling the user after they've interacted. Too late — Article 50(5) requires disclosure before or at first exposure.

3. AI-human confusion. "I'm Sarah, your assistant" without clearly indicating AI nature. Misleading.
